ORDERING
The ordering of goods from us indicates that you are in agreement with all terms and conditions, the buyer agrees to all the terms and conditions set forth by the Bouncing King Company and will adhere to the procedures listed. The methods for procuring merchandise from the company are as follows: a) Purchasing merchandise can be made to the company by using the phone numbers listed on the Sales page. b) By faxing the company. c) By shopping on the company website. Once the order has been placed the buyer will receive an email notification. If at anytime the order needs to be re-edited, the buyer must contact the company and make the necessary changes to ensure the order is properly processed. The Bouncing King Company reserves the right to cancel an order should it become necessary. Once the order is accepted the order therefore becomes a valid contract between the Bouncing King and the buyer. The company reserves the rights to modified the changes pertaining to any of the merchandise sold through the company. The changes in the merchandise and or pricing will be adjusted accordingly and the buyer will be notified as to the changes being made. Once the merchandise is shipped only the name and address on the invoice will receive the merchandise purchased. The Bouncing King is not responsible for merchandise shipped to one location only to have the buyer wanting it shipped elsewhere. It is the buyer’s responsibility in making sure the shipping information is correct. If for any reason an order cannot be fulfilled, the buyer will be notified on what changes need to be made. The buyer then has the right to cancel the order, exchange the item for one similar or another item or request a refund. Customers who financed an order will have a 14-day grace period granting the company the time to adjust the account and or make a prompt refund. From time to time the Bouncing King makes adjustments to the company website such as price modification, product updating, discount offering, news updates and information on discontinued merchandise. Any discrepancies pertaining to the website will be handled promptly and courteously from the Bouncing King organization. The Bouncing King Company assumes responsibility for merchandise before shipping. Once the merchandise is in the buyer’s possession, the buyer is responsible for the handling of the merchandise. The company’s policy is to expedite matters quickly and efficiently.
PAYMENT, PRICING & PROMOTIONS
All prices on the company website are current and any modifications that are made, will be adjusted to the purchase order and the customer will immediately notified as to the changes made. The order can also be cancelled if so desired, notification can be made by phone, fax or email. The company has the right to suspend discounts on merchandise at the company’s discretion. Visa, MasterCard, American Express, Switch, Solo and Delta debit cards are acceptable. Cheques or Postal Orders are also acceptable and deposits on merchandise are non-refundable. a) The Bouncing King Company charges Credit card purchases a charge 2% (excluding US customers). b) Debit cards are not charged a percentage. c) A £29.99 payment is charged for those who choose financed. The payment is charged through the The Bouncing King Sales. Promotions and discounts are honored on the specified dates and the company has the right to discontinue a promotion or discount at the discretion of the company. The merchandise advertised on the website may vary however the Bouncing King works diligently to provide the best quality product and does not assume responsibility for the product variations. Promotions cannot be used with other special offers however the company has reserved the right to substitute cash for a discontinued item. The company also reserves the right not to offer a cash substitute for any discontinued item. The right is reserved for the Bouncing King Company to offer an equivalent product equal in value or even cancel the order if it cannot be fulfilled. Only orders that are specified by the company, will receive the complementary “Package Deal.” This offer means that only certain orders will receive a free gift. The Bouncing King Company reserves the right to suspend any offers that the company chooses hereunder. a) Merchandise not picked up by the buyer will incur a daily storage fee. b) Should at any time an inflatable item becomes non-operational the Bouncing King Company does not assume responsibility for the handling of the merchandise outside the company’s care. c) Always read and follow the directions carefully. d) The English translation of the terms and conditions is the binding translation. e) Access to the website may be denied by the company without notice. h) DVD purchases and business packages are non-refundable. i) All customized inflatable or standard inflatable orders that are cancelled after 24 hours, will be charged a minimum of £250 charge. j) The Bouncing King Company ships all over the world. k) All export orders are non-cancelable and carry a £50 administration fee. All financed customers are covered by the Sales of Goods Act. The “shopping cart” on the website calculates the prices without the VAT number therefore all European customers must provide their country’s VAT number. Notify the company to receive the correct charge for the merchandise purchased online. Buyers who are considered business-to-business are not covered by the Sales of Goods Act however private buyers are.
SHIPPING and DELIVERY
The Bouncing King Company will only ship merchandise that is designated for shipping. Merchandise that is shipped by the company but due to reasons beyond the company’s control such as an act of God, fire, flood, sabotage, accidents, terrorist attacks, transportation issues, Governmental policies, unexpected delivery date changes, labour issues or items lost or stolen-the Bouncing King Company is not liable. Once the merchandise is shipped, the company is not liable and will not assume responsibility for merchandise that is lost or stolen. The Bouncing King Company assumes responsibility for merchandise at the company that is inspected and packaged before the merchandise shipping. All applicable taxes and fees shall be added to the final total of the shipping bill. If for any reason an order cannot be fulfilled a company representative will notify the customer and arrangements will be made as to the processing of the order. The shipping and delivery of merchandise are as follows: a) The customer will be contacted prior to delivery of merchandise. b) Every effort will be implemented to ensure the delivery of merchandise on the specified date and time. c) It is the customer’s responsibility to contact the company if merchandise has not been received. Contact the company either by phone, fax or email. d) One delivery attempted is made then the merchandise is returned to the depot. The customer will be charged for a 2nd delivery. e) The Bouncing King Company is not liable or responsible for the delivery of merchandise once the merchandise is in transport. The company cannot control unforeseen events such as acts of God, weather, highjacking, or tardiness by the delivery service or traffic. If the Next Day Delivery service has not delivered the goods by 4:30pm, contact the company immediately. Every effort will be made to produce the customer’s merchandise. The company phone number is (00444795 75753364) f) The standard delivery is a 3-day delivery and upgrading to Next Day delivery will incur an additional surcharge (this is not applicable to US customers). g) Any export orders that are delayed by Customs is not the responsibility of the Bouncing King Company and is not liable for such delays in delivery. h)If there are any discrepancies with the order it is the customer’s responsibility to contact the Bouncing King within 7-days. If the time has expired and the customer hasn’t reported the discrepancy, then the order is considered a waiver and accepted by the customer. This is part of the terms and conditions agreement and the company has the right not to accept the merchandise or is financially responsible to the customer. All deliveries are curbside deliveries and once the merchandise is placed curbside and an attempt to deliver was made, the company is not liable for items damaged or stolen. Arrangements can be made to deliver the merchandise in place that customer prefers (ex safe box hidden from view). It is the buyer’s sole responsibility to pay for the shipping and delivery of any merchandise purchased from the Bouncing King Company. The company will work diligently with the customer to ensure a safe and easy business transaction.
VIEWING ORDERS
Once the purchasing of merchandise is complete and the transaction has been taken place the customer can view the order. A copy of the order can be viewed online and emailed to the buyer. The site is secured and information is kept confidential. If there are discrepancies with the shipping information or order, the customer can contact the company and re-edit any misinformation.
RETURNS and REPLACEMENTS
The Bouncing King strives to produce and deliver a quality product. In the case where merchandise is returned the following must be adhere to: a) Customized items displaying a logo, phone number or designs cannot be returned. b) The proper paperwork must be included with the return of merchandise. Failure to do may result in the delay of service and may delay in a prompt refund. c) When returning merchandise pack it properly in good condition to the Bouncing King Company, Telford, Shropshire and the items must be returned within 7-10 business days. d) If merchandise is purchased through a 2nd or 3rd party affiliation such as wholesale, gift, used or stolen Bouncing King Company is not responsible or liable for merchandise not working properly. Without the proper documentation and proof of purchase, the company does not have to honour the warranty. e) Upon inspection of item(s) returned if the item were with willful intent, found to have been damaged the company would not honour the warranty, repair or replace the damaged goods. Bouncing King Company reserves the right to dissolve all business affiliations with person(s) at the company’s discretion-who violate the terms and conditions. f) The buyer is solely responsible for the return of any merchandise to the Bouncing King Company. g) Any a fabrication from the customer pertaining to how merchandise was damaged or in explanation for returning merchandise, will result a dissolving of the warranty and the merchandise will be returned. The company will exercise the right to deny any and all claims once inspection of an item is completed and the inspection uncovers any malice. h) The merchandise being returned must be shipped in the original package with all the proper documentation. The merchandise being returned must be clean and dry prior to shipping. i) Merchandise that has to be dried and cleaned prior to inspection, will receive a charge of £50 and VAT charge. The customer is solely responsible for the proper care of the merchandise once the customer is in possession of it. j) The buyer will automatically breach the agreement made with company by violating the terms and conditions pre-set by the Bouncing King Company. When a buyer purchases merchandise with the intent to defame, sabotage, ruin or try to defraud the company, the company reserves the right to take legal action. By purchasing from the Bouncing King Company adhering to the terms and conditions pre-set by the company is implemented. The Bouncing King Company reserves the right to issue a credit to an account or issue a refund based upon the condition and inspection of returned merchandise. The company also reserves the right to substitute or replace merchandise with equal not exceeding value, of the original merchandise returned. Free items used in promotions are exempt from the company’s responsibility if the incorrect “free item” such as a crashmat was delivered. Verbal changes to the warranty do not constitute a binding agreement and will not be honoured by the company-unless the changes are put in writing. If the purchaser subcontracts any inflatable merchandise purchased from the Bouncing King Company and any injury occurs, the purchaser is solely liable and responsible. The company is exempt from any liability pertaining to the usage of merchandise sold. In other words, when the customer purchases a product from the Bouncing King Company, once the product leaves the premises it is solely the purchaser’s responsibility for how the product is used. The Bouncing King Company retains and reserves all rights, trademarks, copyrights, designs, logos and other intellectual properties; pertaining to the Bouncing King Company products, goods, services and material on the company website. No information from company website may be re-produced, used or disseminated in any way without expressed permission from the Bouncing King Company. The potential customer may view, copy or print certain information from the website in order to make a purchase. If any additional information is needed from the Bouncing King Company, call or contact the company by fax or email. Re-producing any inflatable from the Bouncing King Company and distributing or disseminating any information for profit or sabotage, shall result in legal action from the Bouncing King Company. The company shall exercise all their legal rights and take legal action against all parties involved. Any copyright infringement, trademark violations, unauthorised logo re-productions, unauthorized product designs is a violation of the law. Only with the written permission from the Bouncing King Company are any re-productions allowed all other violators will be prosecuted to the fullest extent of the law. Complaints made to the Bouncing King Company are taken seriously and will be remedied. The procedures for filing a complaint are as follows: a) Any and all complaints must be in writing and sent to the Bouncing King Company within 7-days. Failure to comply will be deemed a waiver and the purchaser accepts the merchandise. b) The Bouncing King Company’s remedies shall be cumulative and encompass all remedies allowed by law. In other words, the actions taken to rectify the situation shall be swift. c) If The Bouncing King Company finds that the purchaser’s complaints are unfounded, the company reserves the right to terminate any dealings with the objector. d) In the event of an arbitration hearing and both parties agree to waiver a right to an arbitration hearing and amicable negotiations have been agreed upon, the prevailing faction is entitled to recover a reasonable award.
WARRANTY
The Bouncing King Company is not responsible for replacing or repairing any other product not purchased or manufactured from the company. The warranty under the terms and conditions can be modified by the Bouncing King Company to improve or discontinue certain coverage at the company’s discretion. When changes to the warranty are made the warranty holder will be notified. The Bouncing King Company warranty covers the following: a) All new inflatables are covered with the limited warranty, which is applicable for a period 1-year from the shipping date. b) The Bouncing King Company does not cover merchandise damaged in transport to the factory to be repaired or replaced. c) Any defects in the merchandise upon arrival should be reported to the company within 7-days. Failure to contact the company will be deemed a waiver from the purchaser as acceptance of merchandise by the purchaser. d) Under the warranty, the Bouncing King Company inspects all claims of defects pertaining to merchandise being returned. Once the inspection is completed the company then will take the necessary steps pertaining to the purchaser’s warranty. The purchaser will be notified pertaining to the company’s actions. e) Negligence incurred by the customer is not covered in the warranty. It is the sole responsibility of the purchaser to read and follow all the directions provided with the inflatable. For any questions call the company to speak with Technical Support. f) The warranty does not cover customer abuse of the product such as mishandling of the product during storage or usage. The company reserves the right not to honour the warranty if the customer is negligent, pertaining to the maintenance or storage of the product(s). If the purchaser refused to contact the company in a timely manner about a product purchased; that will be deemed as a waiver by the purchaser and deemed acceptant of merchandise. In other words, the warranty will not be honoured if the purchaser does not properly use the warranty. g) All children’s inflatable products are designed for the usage of children (11-years or younger). If in the event the inflatable becomes damaged from adult usage the Bouncing King Company will terminate the warranty. Adult supervision should be implemented at all times. Any unsupervised child (or children) injured during the use of an inflatable, is the sole responsibility of the purchaser. The company is not responsible for the use of any of its products once the product(s) leaves the premises. The warranty does not cover consumer negligence. h) All inflatable “Activity and Obstacle Courses” come with a limited warranty that does not cover consumer abuse. Such as puncture holes or objects protruding from the inflatable. i) Hand painted artwork is not covered under the warranty. j) Sack/Trolley crashmats come with a 28-day warranty and printed crashmats need to be handled with care. The printed crashmats should be used with the customer only wearing socks. This will aid in prolonging the mat and artwork and prevent damage to the mat. The printed mats should be kept in a dry clean place. k) Generators carry a 6-month warranty. l) Refurbished/Ex-demo inflatable carries a 3-month warranty. As of May 1st, 2004 extended warranties are now available for purchase. The company’s unique 3-year warranty is now available to cover all new customer’s purchases of: a) Children’s Bouncy Slides (suitable for children under 11-years old) b) Obstacle Courses c) Gladiators d) Boxing Sumos Each item comes with a 12-month stitch warranty and both the 12-month and 3-year warranty covers the stitching of the product, not the wear and tear of it. A condition to the warranty’s validity is that every year the inflatable must undergo a safety inspection at the Bouncing King factory. The annual inspection is performed on the anniversary date of the product purchase. The cost of the test is £45. Failure to have the test performed annually will nullify the 3-year warranty. The Bouncing King Company as worked diligently to provide for the inflatable products, a sound warranty. The adult inflatable comes in the standard sizes. a) 15’x 12’ maximum 2-person model b) 15’x 15’ maximum 3-person model c) 15’x 18’ maximum 4-person model The “Airdancers and Skywalkers” inflatable both carry a 90-day warranty and a 6-month warranty for parts and labour. The “Fan” inflatable carries a 1-year warranty. No replacement equipment is available during the warranty inspection. Also exercise care when handling any of these products. The proper care and maintenance will prolong the use of the product. Never wash the inflatable for this may remove the UV protectant. The Bouncing King Company has made every consorted effort to ensure the product is exactly as advertised however there may be slight variations in the size, colour and design of the inflatable. Anytime adjustments need to be made to the customer’s account the customer will be notified.
UPDATING ACCOUNT INFORMATION
Updating account information is an easy process to perform for the new customer or return customer. The client can update the information his/herself by simply going to the company website and setting up an account. Once the account is established the customer can then view the customer profile (customer account) and make any changes necessary to the account. All information is kept confidential. Clients are encouraged to check their account every 3-6 months for accuracy of any and all information. Taking a proactive approach in establishing good business relationships is just one way the Bouncing King Company treats the customer.
PRIVACY and SECURITY
The Bouncing King Company values the privacy of all customers and has worked diligently to provide for a safe and confidential shopping experience. All personal information is kept confidential and at no time is the information sold to anyone. Votes from the company website are tabulated and the information is compiled for research and development purposes only. Client feedback is important to the Bouncing King Company. The information is used as a catalyst in aiding the company in product development and improving customer satisfaction. The Bouncing King Company complies with the governing laws and terms of England and Wales. Encryption technology is implemented to ensure a safe and confidential transaction. The customer has the right to petition in writing that no information is disseminated to any outside party. Only a written agreement from the client granting the use of partial or all information is valid. Assuring the customer that all possible measures are being put into action pertaining to sensitive information being protected is important to the Bouncing King Company. The customer is solely responsible for any misuse of the website due the customer negligence. If the customer cannot use the company website due to reasons beyond the company’s control, the company is not liable or responsible. Whilst every possible measure is being implemented to safeguard the company website sometimes situations arise. The Bouncing King Company will not assume liability or responsibility for such acts as: a) Sabotage b) Computer hacking c) Acts of God d) Power shortages e) Customer negligence f) Unathorised transmission of data by the customer g) Terrorist attacks to the system In the event that a customer willfully or unintentionally corrupts the company computer system through the website with a computer virus, the customer will be held liable for the act. The terms and conditions set forth by the Bouncing King Company are prerequisites to doing business with the company. Any violations of these terms and conditions will result in service with the company being terminated. The Bouncing King Company reserves the right to terminate a business transaction or re-instate a customer at the company’s discretion. If a customer would like to close an account with the Bouncing King Company, a submission in writing must be sent to the company within 7-10 days. The customer must make the request in writing to close down the account. The company will contact the customer to authenticate the request for the account being closed. If the customer owes on an outstanding bill, restitution must be made before the account is closed. Once the account is settled the customer can re-open a new account. The Bouncing King Company set forth the following terms and conditions to be adhere to. From time to time changes may occur pertaining to the policies of the company. Checking the website for updates will keep the customer and potentially new customer abreast of any new products, price changes, discounts, sales or discontinued items. The Bouncing King Company does not store payment information. Customer can opt to store delivery and billing addresses.
